1. OBJECT<\/strong><\/span><\/p>

The purpose of these general conditions of sale is, firstly, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered and, secondly, to define the rights and obligations of the parties in connection with the sale of products by the seller to the consumer.<\/span> They apply, without restriction or reservation, to all sales, by CIYC Europe, of the products offered on its website.<\/span> Accordingly, the fact for any person to order a product offered for sale on the website www.arabianssecret.com<\/a> carries full acceptance of these terms and conditions of sale which the Buyer acknowledges having read<\/a> prior to his order.<\/span> The products are offered for sale in the following geographical territory: Worldwide.<\/span><\/span>
The Buyer prior to his order, declares that:<\/span>
The purchase of products on the website www.arabianssecret.com<\/a> is not directly related to his professional activity and is limited to a strictly personal use;<\/span>
Have full legal capacity, allowing him to commit under these terms and conditions of sale.<\/span>

3. ACCESS TO THE SITE<\/strong><\/span><\/p>

The Buyer is personally responsible for setting up the IT and telecommunications resources to access the www.arabianssecret.com website<\/a> .<\/span>
The Buyer retains the cost of telecommunications when accessing the Internet and use of the site.<\/span><\/p>

4. CONTRACT FORMATION AND ORDERS<\/strong><\/span><\/p>

4.1.<\/strong><\/span> Prices<\/strong><\/span><\/span><\/p>

The selling prices of products online on the website www.arabianssecret.com<\/a> , indicated in multi currencies, are those in effect at the time of registration of the purchase order by the Buyer.<\/span>
They include worldwide shipping costs.<\/span> The shipping costs will be indicated before the registration of the order by the Buyer.<\/span><\/span>
Prices include the value-added tax (VAT) applicable on the day of the order and any change in the applicable rate will be automatically reflected in the price of products sold by www.arabianssecret.com<\/a> on its website.<\/span>
The selling prices of the products can be modified by CIYC Europe at any time.<\/span> This change will be reported to the Buyer prior to any order.<\/span><\/span><\/p>

4.2.<\/strong><\/span> Product features<\/strong><\/span><\/span><\/p>

In accordance with Article L. 111-1 of the Consumer Code, the Buyer may, prior to his order, take note, on the Site www.arabianssecret.com<\/a> , the essential characteristics of the products he wishes to order .<\/span>
The Buyer selects one or more products among the different categories offered on the website www.arabianssecret.com<\/a> .<\/span>
The offers presented by www.arabianssecret.com<\/a> are valid while stocks last.<\/span> For products not stored in its warehouses, the offers presented by www.arabianssecret.com<\/a> are valid subject to availability at its suppliers.<\/span><\/span>
CIYC Europe reserves the right to modify the product assortment according to the constraints related to its suppliers.<\/span>
The photographs, graphics and descriptions of the products offered for sale are only indicative and do not engage the seller.<\/span>
In the event that a supplier modifies a product, the graphic representation of it does not engage the responsibility of the seller or even affect the validity of the sale.<\/span><\/p>

As an exclusive brand, Arabian’s Secret sells products on its site only to retail and end consumers.<\/span> Any order not clearly corresponding to a retail sale and, more generally, any order fraudulent or presumed as such, will be considered by CIYC Europe as null and void.<\/span><\/span><\/p>

5. PAYMENT<\/strong><\/span><\/p>

Payment must be made when ordering by the Buyer.<\/span> At no time, the sums paid can not be considered as a deposit or installments.<\/span><\/span>
All orders are payable in currency customer.<\/span>
To pay for your order, the Buyer has the following payment method: credit card (Carte Bleue, Visa and Master Card), paypal and Cash On Delivery ( CEE ).<\/span>
The Buyer guarantees CIYC Europe that he has the necessary authorizations to use the method of payment he has chosen, when registering the purchase order.<\/span>
CIYC Europe reserves the right to suspend or cancel any order and \/ or delivery, whatever its nature and level of execution, in the event of non-payment of any sum that would be due by the Purchaser or in case of payment incident.<\/span> Penalties of an amount equal to the legal interest rate plus five points are automatically applicable to amounts unpaid after a period of ten days from the date of invoice or notification of the rejection of bank payment for any other means of payment.<\/span> The delivery of any new order may be suspended in case of late payment of a previous order and this notwithstanding the provisions hereof.<\/span><\/span>
CIYC Europe reserves the right to request a photocopy of the identity card of the Buyer for any payment by credit card.<\/span> For amounts exceeding 100 euros, CIYC Europe reserves the right to request a certified photocopy of an identity document.<\/span> As part of the fight against fraud on the Internet, information about your order may be forwarded to any third party for verification.<\/span><\/span>
To ensure the security of payment by credit card, the customer is obliged to transmit to CIYC Europe the visual cryptogram (CVV) of his credit card.<\/span>
CIYC Europe uses a secure payment tool.<\/span> Payment security relies on merchant authentication, ie CIYC Europe, and the confidentiality of all data.<\/span><\/span><\/p>

6. CHOICE OF PRODUCTS<\/strong><\/span><\/p>

The Purchaser having taken knowledge of the products and their characteristics, marketed by CIYC Europe, has under his sole responsibility and according to his needs as they have previously determined before placing any order, made his choice on the product (s) making the object of his order.<\/span> In addition, the Buyer knowing only the products he owns and uses, is the sole judge of the compatibility of the products ordered with those used by him.<\/span> It is the sole responsibility of the Purchaser, if he does not consider himself competent enough, to be assisted by counsel.<\/span><\/span><\/p>

7. DELIVERY AND RECEPTION<\/strong><\/span><\/p>

7.1.<\/strong><\/span> General rules<\/strong><\/span><\/span>
The products will be delivered to the address indicated by the Buyer on the order form Warehouse to worldwide.<\/span>
By default, invoices are sent to the e-mail address indicated by the Customer when they are registered.<\/span>
Failure to comply with the procedures set out below, no claim of the Buyer will be accepted.<\/span><\/p>

7.2.<\/strong><\/span> Delivery characteristics by DPD<\/strong><\/span><\/span>
The buyer is delivered to his home by the delivery company DPD \/ Fedex \/ DHL.<\/span> In case of absence of the Buyer or the recipient, the package is left pending 15 days in the nearest Pickup office.<\/span> After this period, the package is returned to CIYC Europe.<\/span><\/span>
The buyer is required to check in the presence of the deliveryman the condition of the package and the number of packages delivered.<\/span> In case of doubt, he must refuse the package and report these incidents to contact@arabianssecret.com<\/a> .<\/span><\/span><\/p>

7.3.<\/strong><\/span> time<\/strong><\/span><\/span><\/p>

Delivery times, following the sending of your order, are as follows:<\/span>
– DPD Tracking for European Union: 7 working days<\/span>
– Fedex \/ DHL\u00a0 for International and Overseas: 7 working days on average. For any order confirmed from Monday to Friday (excluding holidays), the sending of the order will take place 48 hours after validation in the limit of available stock.<\/span> These deadlines are provided for information only.<\/span><\/span>
Any overrun may not give rise to damages, withholding or cancellation of the order by the Buyer.<\/span>
In any case, and in accordance with the provisions of Article L. 121-20-3 of the Consumer Code, the products ordered will be delivered within a maximum of thirty days from the day following the day on which the Buyer has registered his order, subject to full payment of the price.<\/span>
Failure to deliver at the end of this period, the Buyer will have the opportunity to cancel the order.<\/span> The sums paid by the Buyer will be returned to him without delay, to the exclusion of any other compensation.<\/span><\/span>
In case of delay of delivery compared to the date initially fixed, the Buyer will have to announce it in writing (mail, fax, mail) to contact@arabianssecret.com<\/a> in order to improve the quality of service which can be proposed to him and of allow CIYC Europe to conduct a survey with the carrier.<\/span>
An investigation with the carrier can take up to 21 working days.<\/span> If during this period, the product is found, it will be immediately re-routed to the place of delivery designated in the order form.<\/span> On the other hand, if the ordered product is not found at the end of this period of 21 days of investigation, CIYC Europe will carry out at its expense a new shipment of the products ordered by the Buyer.<\/span><\/span>
In case of exchange of product, the delivery costs will be borne by the consumer.<\/span><\/p>

7.4.<\/strong><\/span> Return of products<\/strong><\/span><\/span>
The products can be returned by the Buyer under the conditions and according to the instructions below.<\/span> The products must be returned to CIYC Europe in a perfect state of resale, in their original condition (packaging, accessories, instructions …), duly sealed, and accompanied by the signed return slip.<\/span><\/span><\/p>

7.4.1.<\/strong><\/span> Return by mail<\/strong><\/span><\/span>
CIYC Europe accepts the return of any item purchased on www.arabianssecret.com<\/a> if it is returned within 1 month from the date of receipt of the order by the Buyer.<\/span> The shipping costs of the return package remain the responsibility of the Buyer.<\/span> Initial delivery costs are not refunded.<\/span> To return an item, the Buyer must follow the following instructions:<\/span><\/span>
1. Use the original packaging to return the product accompanied by the delivery note.<\/span>
2. Returns without a Delivery Note are not accepted.<\/span>
3. Send the parcel to the following address: CIYC Europe, 131 Bul. Hristo Botev, 1233 Sofia – Bulgaria.<\/span> CIYC Europe does not accept parcels sent by postage due.<\/span> Any risk related to the return of the product is the responsibility of the Buyer.<\/span> Failure to comply with the procedure outlined above and the times indicated, the Buyer will not make any claim for non-compliance or defect of the delivered products, the products then being deemed compliant and free from any defect apparent.<\/span><\/span><\/p>

8. RIGHT OF WITHDRAWAL<\/strong><\/span><\/p>

In accordance with Article L. 121-20 of the Consumer Code, the Buyer has a period of 14 days from the date of receipt, to return at its expense, the products ordered for reimbursement.<\/span> The products must be returned to CIYC Europe, 131 Bul. Hristo Botev, 1233 Sofia – Bulgaria in a perfect state of resale, in their original condition (packaging, accessories, instructions …), duly sealed, and accompanied by the good return signed in accordance with the procedure described in article 7.5 above.<\/span><\/span><\/p>

9. PROPERTY RESERVE<\/strong><\/span><\/p>

CIYC Europe retains the full ownership of the products sold until the perfect collection of the price, principal, fees and taxes included.<\/span><\/p>

10. RESPONSIBILITY<\/strong><\/span><\/p>

CIYC Europe can not be held responsible for the non-performance of the contract in case of out of stock or unavailability of the product due to force majeure, disruption or total or partial strike including postal services and means of transport and \/ or communications.<\/span>
CIYC Europe can not be held responsible for any indirect damage that may occur due to the purchase of products.<\/span>
CIYC Europe can not be responsible for any loss of data, files.<\/span> It is the Buyer’s responsibility to make all necessary backups.<\/span> The website www.arabianssecret.com<\/a> also contains information from third parties and links to other websites.<\/span> CIYC Europe can not be held liable for any damages resulting from the use, access to, or inability to use such third party information or the content of other websites.<\/span><\/span><\/p>

11. PARTIAL NON-VALIDITY<\/strong><\/span><\/p>

If one or more stipulations of the present general conditions of sale are held for invalid or declared as such under a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their strength and reach.<\/span><\/p>

12. NON-WAIVER<\/strong><\/span><\/p>

If the fact for one of the parties not to invoke a breach with the other party to any of the obligations referred in these general conditions of sale can not be interpreted for the future as a waiver of the obligation in question.<\/span><\/p>

13. APPLICABLE LAW AND COMPETENT JURISDICTION<\/strong><\/span><\/p>
