4. CONTRACT FORMATION AND ORDERS

4.1. Prices

They include worldwide shipping costs. The shipping costs will be indicated before the registration of the order by the Buyer.

5. PAYMENT

Payment must be made when ordering by the Buyer. At no time, the sums paid can not be considered as a deposit or installments.
All orders are payable in currency customer.

CIYC Europe reserves the right to suspend or cancel any order and / or delivery, whatever its nature and level of execution, in the event of non-payment of any sum that would be due by the Purchaser or in case of payment incident. Penalties of an amount equal to the legal interest rate plus five points are automatically applicable to amounts unpaid after a period of ten days from the date of invoice or notification of the rejection of bank payment for any other means of payment. The delivery of any new order may be suspended in case of late payment of a previous order and this notwithstanding the provisions hereof.
CIYC Europe reserves the right to request a photocopy of the identity card of the Buyer for any payment by credit card. For amounts exceeding 100 euros, CIYC Europe reserves the right to request a certified photocopy of an identity document. As part of the fight against fraud on the Internet, information about your order may be forwarded to any third party for verification.
To ensure the security of payment by credit card, the customer is obliged to transmit to CIYC Europe the visual cryptogram (CVV) of his credit card.

6. CHOICE OF PRODUCTS

The Purchaser having taken knowledge of the products and their characteristics, marketed by CIYC Europe, has under his sole responsibility and according to his needs as they have previously determined before placing any order, made his choice on the product (s) making the object of his order. In addition, the Buyer knowing only the products he owns and uses, is the sole judge of the compatibility of the products ordered with those used by him. 7. DELIVERY AND RECEPTION

7.1. General rules
The products will be delivered to the address indicated by the Buyer on the order form Warehouse to worldwide.

7.2. Delivery characteristics by DPD
The buyer is delivered to his home by the delivery company DPD / Fedex / DHL. In case of absence of the Buyer or the recipient, the package is left pending 15 days in the nearest Pickup office. After this period, the package is returned to CIYC Europe.
The buyer is required to check in the presence of the deliveryman the condition of the package and the number of packages delivered. In case of doubt, he must refuse the package and report these incidents to contact@arabianssecret.com .

7.3. time

Delivery times, following the sending of your order, are as follows:
– DPD Tracking for European Union: 7 working days
– Fedex / DHL  for International and Overseas: 7 working days on average. For any order confirmed from Monday to Friday (excluding holidays), the sending of the order will take place 48 hours after validation in the limit of available stock. These deadlines are provided for information only.
Any overrun may not give rise to damages, withholding or cancellation of the order by the Buyer.
In any case, and in accordance with the provisions of Article L. 121-20-3 of the Consumer Code, the products ordered will be delivered within a maximum of thirty days from the day following the day on which the Buyer has registered his order, subject to full payment of the price.
Failure to deliver at the end of this period, the Buyer will have the opportunity to cancel the order. The sums paid by the Buyer will be returned to him without delay, to the exclusion of any other compensation.
In case of delay of delivery compared to the date initially fixed, the Buyer will have to announce it in writing (mail, fax, mail) to contact@arabianssecret.com in order to improve the quality of service which can be proposed to him and of allow CIYC Europe to conduct a survey with the carrier.
An investigation with the carrier can take up to 21 working days. If during this period, the product is found, it will be immediately re-routed to the place of delivery designated in the order form. On the other hand, if the ordered product is not found at the end of this period of 21 days of investigation, CIYC Europe will carry out at its expense a new shipment of the products ordered by the Buyer.
In case of exchange of product, the delivery costs will be borne by the consumer.

7.4. Return of products
The products can be returned by the Buyer under the conditions and according to the instructions below. The products must be returned to CIYC Europe in a perfect state of resale, in their original condition (packaging, accessories, instructions …), duly sealed, and accompanied by the signed return slip.

7.4.1. Return by mail
CIYC Europe accepts the return of any item purchased on www.arabianssecret.com if it is returned within 1 month from the date of receipt of the order by the Buyer. The shipping costs of the return package remain the responsibility of the Buyer. Initial delivery costs are not refunded. To return an item, the Buyer must follow the following instructions:
1. Use the original packaging to return the product accompanied by the delivery note.
2. Returns without a Delivery Note are not accepted.
3. Send the parcel to the following address: CIYC Europe, 131 Bul. Hristo Botev, 1233 Sofia – Bulgaria. CIYC Europe does not accept parcels sent by postage due. Any risk related to the return of the product is the responsibility of the Buyer. Failure to comply with the procedure outlined above and the times indicated, the Buyer will not make any claim for non-compliance or defect of the delivered products, the products then being deemed compliant and free from any defect apparent.

8. RIGHT OF WITHDRAWAL

In accordance with Article L. 121-20 of the Consumer Code, the Buyer has a period of 14 days from the date of receipt, to return at its expense, the products ordered for reimbursement. The products must be returned to CIYC Europe, 131 Bul. Hristo Botev, 1233 Sofia – Bulgaria in a perfect state of resale, in their original condition (packaging, accessories, instructions …), duly sealed, and accompanied by the good return signed in accordance with the procedure described in article 7.5 above.

9. PROPERTY RESERVE

CIYC Europe retains the full ownership of the products sold until the perfect collection of the price, principal, fees and taxes included.

10. RESPONSIBILITY

CIYC Europe can not be held responsible for the non-performance of the contract in case of out of stock or unavailability of the product due to force majeure, disruption or total or partial strike including postal services and means of transport and / or communications.

CIYC Europe can not be responsible for any loss of data, files. It is the Buyer’s responsibility to make all necessary backups. 11. PARTIAL NON-VALIDITY

If one or more stipulations of the present general conditions of sale are held for invalid or declared as such under a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their strength and reach.

12. NON-WAIVER

13. APPLICABLE LAW AND COMPETENT JURISDICTION

Any dispute relating to the interpretation, execution or breach of the contract concluded between CIYC Europe and the Buyer, even in the case of multiple defendants, will, failing amicable agreement, be the exclusive jurisdiction of the courts of Sofia .
